TERMS AND CONDITIONS
The sale of the products contained in the virtual catalogues on the web page www.cellini-shop.com (hereinafter “Products”) is governed by the following General Conditions of Sale formulated in compliance with the regulations on contracts concluded outside business premises and in particular by the provisions of Legislative Decree no. 206 of 6 September 2005 (Consumer Code).

APPLICATION OF THE GENERAL CONDITIONS OF SALE
Before making the purchase, the Customer is invited to read these General Conditions carefully and is authorized to store, reproduce, download a copy and/or print them. DESCRIPTION AND CHARACTERISTICS OF THE SERVICE FOR THE SALE OF PRODUCTS
The service for the sale of Products activated on the Site includes registration, access to selections, the choice of Products, the on-line transmission of the purchase order and the possible on-line acceptance of the purchase order, in compliance with Art. 50 to 61 of the Consumer Code.
Registration
The service is active regardless of registration, which is optional. The customer who wishes to register can refine his registration by sending “username” and “password”. The customer who does not wish to register, can still conclude the purchase by providing only the data necessary for the delivery and billing of the order. The purchase and/or registration implies acceptance of the above mentioned General Conditions governing the supply contract of the Products, as well as consent to the processing of personal data. In case of registration, the Customer is required to keep the password with the utmost diligence, undertaking not to allow the use of the service by third parties not expressly authorized by him, for whose behavior on the network he assumes all responsibility.
In case of loss, theft or loss of the password, the Customer will have the right to activate the procedure for the release of a new password on the Site. Purchase order Each purchase order received by LaVelaPortofino must clearly contain information about the Product code, the description of the same, the quantity, the address and the name of the recipient.
The order procedure on the Site provides the possibility of identifying and correcting data entry errors before the purchase order is placed. The purchase order sent by the Customer constitutes a binding contractual proposal for the Customer pursuant to Art. 1326 of the Italian Civil Code. To confirm receipt of the order, LaVelaPortofino will send the Customer a summary e-mail to the e-mail address indicated in the registration. The e-mail is for information purposes only pursuant to Article 13 of Legislative Decree 70/2003 and does not constitute acceptance by LaVelaPortofino of the order.

CHARACTERISTICS OF THE PRODUCTS
The Products are shown in the Online Catalogue in such a way as to correspond, as far as possible, to the exact characteristics possessed. The images published as general information material may not exactly correspond to reality. The Products shown in the Online Catalogue may be purchased while stocks last, it being understood that LaVelaPortofino reserves the right not to make some Products available at any time and/or to modify their characteristics. LaVelaPortofino also reserves the right to update, at any time, the Online Catalogue, changing the range or number of products.
PRODUCT PRICES
The price of the Products is the one resulting from the Price List published on the Site and in force at the time the Customer sends the order.
The prices of the Products published on the Site are in Euro, including standard packaging and/or packaging and VAT, the rate of which is determined in relation to the type of Product. Prices do not include transport and delivery costs. All the above costs (delivery and special packaging / packaging), not included in the prices of the Products published on the Site, will be separately indicated in the order summary and confirmed in the order acceptance e-mail that will be sent to the customer by LaVelaPortofino.
In addition, for deliveries to be made in Other States, to Campione d’Italia, Livigno, Channel Islands and Canary Islands, the prices of the Products published on the website www.cellini-shop.com are always understood not to include:
a) any taxes and/or sales taxes;
b) any taxes and/or customs charges
c) any other taxes and/or charges applicable to the delivery of the Products ordered.
The Customer shall be required to pay all taxes and customs charges applicable in the country of delivery of the ordered Products. Any and all charges or costs relating to the customs clearance of the Products delivered shall remain the exclusive responsibility of the recipient of the delivery.
WARRANTY
Legal guarantee In accordance with Articles 128 to 135 of the Consumer Code, LaVelaPortofino guarantees that the Products purchased online are free from defects and comply with the sales contract. The Product Warranty is provided by the manufacturer in line with the applicable legislation.
Any defects or non-conformities of the Products must be reported by the Customer promptly and in any case within the terms of the law by registered letter with acknowledgement of receipt addressed to:

In default, the Products shall be deemed accepted at the time of delivery. The aforesaid guarantee given by LaVelaPortofino shall be forfeited if the defect in the Product is the result of negligence or improper use or accidental event; the defect in the Product is the result of normal wear, oxidation or atmospheric agents; the Customer, at the time of conclusion of the sales contract, was aware of the defect in the Product or could not ignore it with ordinary diligence; the Product has been disassembled, tampered with, modified and/or repaired.
Factory warranty
In addition to the legal warranty referred to in the previous Art., some Products may be covered by a commercial warranty of the manufacturer (factory warranty), possibly contained in the packaging of the Product, for the duration and according to the terms and conditions written on the relevant warranty certificate.
PRODUCT LIABILITY
In its capacity as seller, LaVelaPortofino is liable for damages caused by the Products in accordance with Articles 114 to 127 of the Consumer Code, it being understood that, in its capacity as seller, LaVelaPortofino may be released from liability by indicating the name of the manufacturer.
AFTER SALES SERVICE
In the event that the Customer finds irregularities with respect to his order (delivery of incorrect items, defective products, lack of products, etc.), is not satisfied with the service provided or would like information about the Products, he can contact the Customer Service at the following email address: . GENERAL PROVISIONS
Possible tolerances, even repeated, of violations or non-fulfilments cannot constitute precedent nor infirm the validity of both the clauses ignored and the other clauses of these General Conditions. Should any clause of these General Conditions be or become void or invalid at a later date, it is established that it will be interpreted in the sense in which it may maintain some validity, even if reduced with respect to the initial object, and in any case in the sense in which it may have some effect. In any case, the nullity or invalidity of a clause of these General Conditions will not invalidate these General Conditions in their other clauses and in their entirety.
APPLICABLE LAW AND PLACE OF JURISDICTION

These General Conditions and the sales contracts concluded through the procedure activated on the Site, are governed by Italian law, without prejudice to any unavailable rights of the Customer guaranteed by the mandatory regulations of his country of residence. The application of the 1980 Vienna Convention on international sales is expressly excluded.
Jurisdiction
The sale of products and/or services takes place in the territory of the Italian State and is subject to the laws in force in the Italian Republic. Jurisdiction for the resolution of any dispute will be that provided for by Italian law in force at the time of conclusion of the contract.

Payment by Credit Card is made on the Setefi payment system. The credit or prepaid cards that can be used are the following: Visa, Mastercard, Diners and JCB.
Choosing to pay by Visa and Mastercard credit cards, payment must be made at the time the purchase order is placed; payment will be made on the Setefi circuit, which will automatically check the card’s operation at the time the order is placed, sending an e-mail indicating the outcome of the transaction; the credit is actually collected at the time the goods are shipped. Security: if, after verification, the transaction is not secure, LaVelaPortofino will cancel the order.
At no time during the purchase procedure LaVelaPortofino is able to know the buyer’s credit card information and credit card number or financial, asset and personal information of the Customer. This information is in fact transmitted at the time of the Customer’s confirmation via a secure connection directly to the bank portal or the financial company.

Payment by Cash on Delivery
Payment on delivery by Cash on Delivery is possible throughout Italy.
Pursuant to Art. 54 of the Consumer Code, the Products that are available in the warehouse of LaVelaPortofino will, as a rule, be delivered in the shortest possible time and in any case, indicatively: in Italy, within 3-5 working days from receipt of payment by LaVelaPortofino; in EU countries other than Italy and in other countries, within 5 working days from receipt of payment by LaVelaPortofino.
The delivery will be made from Monday to Friday during working hours, by a specialized freight forwarder, with packaging prepared by LaVelaPortofino to the address of the recipient indicated by the Customer. The delivery terms indicated above refer to the products in its warehouses and are non-binding for LaVelaPortofino, which may subsequently confirm or modify them, depending on its needs. The Products will be delivered, properly packaged and / or packaged, by courier chosen by LaVelaPortofino, to the address of the recipient indicated by the Customer at the time of transmission of the purchase order.
Upon receipt of the Products, the consignee must verify that the Products correspond, also in number, to the Products ordered, it being understood that, in the event of discrepancies between the Products delivered and the Products ordered, the Customer may exercise the right of withdrawal under Art. 7 below.
Transport costs will be calculated on the basis of the weight of the goods, or on the basis of the weight/volume ratio and the place of delivery of the Products, according to agreements defined with the shipping agent in charge of delivery and clearly indicated to the Customer both when purchasing the Products and in subsequent confirmation messages.
Any problems relating to physical integrity, correspondence or completeness of the products received must be reported to the e-mail address info@lavelaportofino.com of LaVelaPortofino within 10 working days of receipt of the goods.
